The Australian Competition and Consumer Commission (ACCC) is planning to take legal action against Apple regarding its claim that its new iPad supports 4G services in the country, by making an application to the Federal Court in Melbourne accusing Apple of contravening the Australian Consumer Law.

The action stems from the fact that Apple promotes the iPad with WiFi + 4G as being able to connect to 4G mobile data networks using a SIM card, when this isn’t currently the case in Australia.

The ACCC wants immediate legal action to be taken to make consumers aware of the actual capabilities of the devices they are purchasing. In addition, the competition body is looking to impose injunctions and fines on Apple as well calling for corrective advertising and refunds for affected consumers.

The news follows reports that the LTE-enabled iPad appears to only work on networks in the US and Canada as it does not support the different radio frequencies use to support the technology in other countries.
